# Digital Asset Terms — NaviStar

*(incorporating the Risk Disclosure)*

*Version 1.0 · Effective July 4, 2026 · `earthlinc.earth`*

These Terms govern the **two on-chain assets** of the Earth LinC Service — the **minted station** and the **NaviStar** — and the keys, custody, and risks that come with holding them. They are part of the Terms of Service. The commercial Service is operated by **Kong Group LLC** ("**we**," "**us**"). Capitalized terms follow the Terms of Service and the Earth LinC Protocol Specification.

## 1. The two assets

**The minted station.** Composing and Broadcasting are off-chain. When you **mint** your station, it takes permanent, on-chain form — anchored, sovereign, yours. At the mint you choose what it carries: a **YuCROWN mission** (your payment is then a charitable **Drop** — Donation Terms govern) or **plain** (an ordinary commercial purchase from Kong Group). Either way, the minted station is an on-chain asset of yours; carrying a mission, it is also **grounded** — bound to a verified, real action for this earth.

**The NaviStar.** From your minted station, each **Cast** mints a **NaviStar** (an **ERC-1155** token on the **Polygon** network) to a person you choose. Every Cast is a commercial purchase from Kong Group. A NaviStar has two layers:

* an **immutable verified-fact layer** — where the station carries a mission, the verified ecological action (what, where, when, as confirmed by an independent, accountable source); permanent and unchangeable by anyone, including us;
* a **pointer to the living page** — the authored, composed page kept off-chain (its IP terms are in the IP & DMCA Policy).

A NaviStar lands in the recipient's **Realm** — their sovereign on-chain space, built on open standards (ERC-1155, ERC-721, ERC-6551). Sovereign means exactly this: the asset is yours under the rules of the public blockchain itself; it does not depend on your account with us, and it survives the Service (Terms of Service §14).

## 2. What these assets are not

This section is deliberately blunt, and applies to **both** the minted station and the NaviStar.

* **Not an investment.** The Station and NaviStars are cryptographic records minted strictly on behalf of, and by the directional command of, the holder; they are not issued by the protocol or its operators as investment instruments. The protocol operates no secondary market, makes no representation of extrinsic monetary value, and offers no expectation of profit, appreciation, or financial return derived from the managerial or entrepreneurial efforts of others.
* **Not a security, and not offered as one.** Nothing on the Service is an offer to sell or a solicitation to buy any security or financial instrument, in any jurisdiction.
* **Not a currency, a stored-value product, or a payment instrument.**
* **Not a carbon credit or environmental offset.** The verified-fact layer records that an action occurred; it does not create, represent, or transfer any offset, credit, or environmental attribute, and may not be used or resold as one.
* **Not the copyright** in the pages they point to (IP & DMCA Policy §3).
* **A Cast is a purchase of the act, not of a financial product:** what you buy from Kong Group is the service of minting and delivering a NaviStar to your chosen recipient — a connection, not an instrument.

## 3. Transfer: fully yours

A NaviStar is **the holder's own and fully transferable**:

* You may move it **between your own keys**, and you may give it **as a gift** — the whole star moves, the verified-fact layer travels with it, immutable.
* Disposal and onward transmission are a factual function of your own cryptographic key control. We operate no secondary market for it, and the Service and its proprietary infrastructure may not be used to construct, host, list, or operate one (Acceptable Use Policy §3).
* *Why it is yours:* the star must be wholly the holder's — sovereignty is the point. The whole star moves; the verified-fact layer travels with it, immutable. (Protocol Specification, Part C.)

Transferring a Realm (the Signet that controls it) follows the same principle: it is the holder's own, transferable as a whole or as a gift, and disposal is a factual function of key control. The same applies to a minted station — the holder's own, minted on the holder's behalf and not issued, transferable as a matter of property fact.

## 4. Custody and self-custody

* **Custody-by-default.** NaviStars Cast to you are held for you in managed custody infrastructure, so you can receive with no crypto setup. While in custody, we safeguard the keys and act only on your instructions through the Service.
* **Self-custody, any time.** You may move your assets (or your whole Realm) under keys you control. From that moment, **you alone hold the keys**: we cannot move, freeze, recover, or restore anything in self-custody. Lost keys mean lost access — permanently. (Terms of Service §3.)
* Custody is provided to make receiving possible; it is not a deposit account, not banking, and earns nothing.

## 5. Risk disclosure

Hold and use on-chain assets only with these understood:

* **Irreversibility.** On-chain actions are permanent. A mint cannot be un-minted; a Cast cannot be un-Cast; a mistaken transfer cannot be undone by anyone.
* **Key risk.** In self-custody, whoever holds the keys holds the assets. Phishing, malware, and seed-phrase theft are real and common; no legitimate message from us will ever ask for your keys or seed phrase.
* **Smart-contract risk.** Contracts are code. Audited or not, code can contain defects; an exploit could affect tokens or accounts in ways no one can reverse.
* **Network risk.** Polygon and Ethereum-aligned networks can suffer congestion, fee spikes, reorganizations, forks, or outages we do not control.
* **Service dependency — bounded.** Your assets are sovereign and survive us; but the **living pages** they point to are served off-chain. If the Service ceased, the on-chain records (the station, the stars, the verified-fact layers, the constellation) would remain; the hosted pages might not.
* **Regulatory risk.** The law of digital assets is evolving in every jurisdiction. Future law could affect how these assets may be held, transferred, or treated for tax.
* **Tax.** Receiving, gifting, or transferring a digital asset can have tax consequences that vary by jurisdiction. **Nothing here is tax, legal, or financial advice.**

## 6. Prohibited uses

You may not use stations, NaviStars, Realms, or the Service's on-chain features to launder money, evade sanctions, manufacture fake records (Acceptable Use Policy §1, §3), or in any attempt to create a market in NaviStars. We comply with applicable sanctions law, and on-chain features are unavailable to restricted persons and jurisdictions (Terms of Service §15).

## 7. Forks, migrations, and standards

If the underlying network forks or a contract migration is ever required (for example, for security), we will say so publicly and handle custodied assets with reasonable care; self-custodied holders will receive instructions but act for themselves. The protocol's substrate (Polygon · ERC-1155 + ERC-721 + ERC-6551) is constitutional in the Protocol Specification; any change to it would be a protocol-level event, not a quiet swap.

## 8. No advice, no warranty

We provide infrastructure, not advice. Everything in §5 notwithstanding, the Service and all on-chain features are provided **"as is"** (Terms of Service §11), and our liability is limited as set out in the Terms of Service §12.

## 9. Changes

We may update these Terms; material changes are announced as described in the Terms of Service. The properties of already-minted assets — permanence, the verified-fact layer, and the NaviStar's sovereignty and transferability — do not change.
