# Terms of Service

*Version 1.0 · Effective July 4, 2026 · `earthlinc.earth`*

These Terms of Service ("**Terms**") govern your access to and use of the Earth LinC website, application, and related services at `earthlinc.earth` (together, the "**Service**"). The Service is operated by **Kong Group LLC** ("**Kong Group**," "**we**," "**us**," "**our**"). When a station is minted carrying a YuCROWN mission, that payment is a charitable **Drop** received by **YuCROWN Corporation**, a 501(c)(3) nonprofit organization ("**YuCROWN**").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

> Earth LinC is an open, on-chain protocol. The Service is one way to use it. These Terms govern your use of the Service — they do not govern or limit the protocol itself, which anyone may build on. Capitalized terms not defined here follow the Earth LinC Protocol Specification.

## 1. Who may use the Service

You may use the Service only if you are at least **18** years old and able to form a legally binding contract. You may not use the Service where its use is prohibited by law, or if you are subject to the restrictions in §15 (Restricted Jurisdictions). By using the Service, you represent that you meet these requirements.

## 2. What the Service does

Earth LinC gives an action for this earth a permanent, sovereign form on-chain. Through the Service you can:

* **Broadcast** — open a **station** and share it openly and for free. A Broadcast is off-chain and public.
* **mint** — give your station its permanent, on-chain form. At the mint you choose what it carries: a **YuCROWN mission** (your payment is then a charitable **Drop**) or plain (an ordinary purchase).
* **Cast** — from your minted station, mint a **NaviStar** to a person you choose. A Cast is on-chain and permanent.
* **keep** — hold the NaviStars Cast to you in your **Realm**, your sovereign on-chain space.

These are the protocol's only acts. Composing a station may use AI tools (see §7). The Service is content-agnostic: what a station is about is yours.

**2.3 Availability.** The underlying open-source protocol is permissionless, decentralized, and governed by no central authority. However, the official interfaces, applications, properties, and services operated by us — including without limitation earthlinc.earth, the NaviCanvas interface, any minting or Casting features, and official support channels (collectively, the "**Company Services**") — are subject to U.S. export control and economic sanctions laws. The Company Services are strictly unavailable to, and may not be accessed by, any individuals or entities located in, or nationals of, comprehensively-sanctioned jurisdictions, or those identified on restricted-party lists (including OFAC's SDN List). Furthermore, specific feature sets that integrate or rely on third-party Artificial Intelligence (AI) components or third-party payment infrastructure are further restricted and available exclusively within the specific permitted geographic white-lists designated by such third-party upstream providers. We implement commercially reasonable geographic controls (including IP-level blocking) to enforce these limits; however, you acknowledge that circumventing such controls constitutes a material breach of these Terms, and use of the Company Services is strictly prohibited wherever prohibited by applicable law.

## 3. Accounts, keys, and custody

To keep a NaviStar you need a place for it to live on-chain. By default, NaviStars Cast to you are held in **custody** on your behalf, so you can receive without any prior crypto setup. You may at any time move to **self-custody** and hold your NaviStars under keys you control.

If you choose self-custody, you are solely responsible for safeguarding your keys. We do not hold your self-custody keys and **cannot recover** them or their contents if they are lost. You are responsible for all activity that occurs under your account or your keys.

## 4. Payments — one destination each

Every payment on the Service goes, whole, to exactly one entity — **never split**:

* **A mint carrying a YuCROWN mission** is a **Drop**: a charitable contribution, the **full amount to YuCROWN**, governed by the [**Donation Terms & Charitable Disclosures**](/protocol/legal-and-policies/donation-terms-and-charitable-disclosures.md). A Drop is **non-refundable** except as stated there.
* **Everything else** — composing beyond the free allowance (subscriptions and credits), **plain mints**, and **every Cast** — is an ordinary commercial purchase from **Kong Group**, governed by the [**Payment & Refund Policy**](/protocol/legal-and-policies/payment-and-refund-policy.md).

Your choice at the mint routes the payment; your acknowledgment states which kind you made, and to whom. Payments are handled by third-party payment processors. Charitable funds and commercial revenue are never commingled.

You are responsible for any network fees ("gas") and for any taxes arising from your use of the Service, other than taxes on our income.

## 5. On-chain assets — the minted station and the NaviStar

* A **minted station** is your station's permanent on-chain form — anchored, sovereign, yours. Carrying a mission, it is also **grounded** — bound to a verified, real action for this earth.
* A **NaviStar** is an on-chain token (ERC-1155) recorded on the **Polygon** network, minted by a Cast from a minted station. It is **yours** — sovereign to you, its holder.
* A NaviStar is **the holder's own and fully transferable** (between your own keys, as a gift, or onward). The Station and NaviStars are cryptographic records minted strictly on behalf of, and by the directional command of, the holder; they are not issued by the protocol or its operators as investment instruments. The protocol operates no secondary market, makes no representation of extrinsic monetary value, and offers no expectation of profit, appreciation, or financial return derived from the managerial or entrepreneurial efforts of others. * On-chain records are **permanent**. Once minted, a station, a NaviStar, and its verified-fact layer cannot be edited or deleted — by you or by us.
* You acknowledge the inherent risks of blockchain technology, including smart-contract risk, network fees, congestion, and the irreversibility of on-chain actions (see §11).

## 6. Verified ecological action

A mint can carry a **mission** — a real ecological action, funded by the Drop and confirmed by an **independent, accountable source before it is recorded**. We do not record a physical-world claim that has not been independently verified.

We do not guarantee any specific environmental outcome beyond what has been verified, and the Service makes no representation that any action offsets, neutralizes, or reverses any particular environmental impact.

## 7. Your content and AI composition

You retain your rights in the expression you author. By composing or Broadcasting, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that expression as needed to operate the Service. AI composition tools help give your action a living form. **AI composes authored, human-supplied expression only; it never generates, alters, or asserts verified ecological fact.** You are responsible for the content you compose, Broadcast, or Cast, and you must follow the [**Acceptable Use & Content Policy**](/protocol/legal-and-policies/acceptable-use-policy.md).

## 8. Acceptable use

You agree not to use the Service to: break any law; infringe others' rights; upload or compose content that is unlawful, harmful, deceptive, hateful, or sexually exploitative; misrepresent or fabricate ecological fact; interfere with or attack the Service; or attempt to circumvent the protocol's integrity boundary. Full rules are in the [**Acceptable Use & Content Policy**](/protocol/legal-and-policies/acceptable-use-policy.md). We may remove content or restrict access for violations.

**7.3 Transience of AI Outputs.** You acknowledge and agree that all AI-generated suggestions, compositions, layouts, and outputs generated via the NaviCanvas interface or any related features are entirely transient, ephemeral, and non-persistent in nature. We do not host, store, or guarantee the ongoing preservation, backup, or availability of any temporary AI outputs on our servers. Due to the stochastic and non-deterministic nature of underlying large language models, we do not guarantee that any output can or will be replicated, reproduced, or recovered once closed or un-saved. You are solely responsible for immediately exporting, saving, or anchoring any required content onto the immutable ledger layer via the Protocol.

**7.4 Decoupling of On-Chain Records and Display Surfaces.** The Earth LinC protocol functions as a decentralized, permissionless ledger layer where on-chain records are persistent and irreversible. However, the user-facing interfaces, "feeds," indexed views, and display spaces operated by Kong Group LLC (including the NaviCanvas display) are entirely distinct, centralized aggregation surfaces. We maintain absolute discretion, structural control, and the unilateral right to moderate, filter, take down, suspend, or permanently cease the display or indexing of any station, content, or record on our official properties at any time, for any reason, or for no reason, without prior notice or liability to you. A record's persistence on the underlying blockchain protocol does not grant, imply, or guarantee any right of continuous visibility, indexing, or display on Company-operated surfaces.

## 9. Intellectual property

The Service, and all software, text, design, and marks we provide (other than your authored content and your NaviStars), are owned by us or our licensors and are protected by law. We grant you a limited, revocable, non-transferable license to use the Service under these Terms. Rights in your authored content and your sovereign on-chain assets remain as described in §5 and §7.

## 10. Privacy

Your use of the Service is subject to the [**Privacy Policy**](/protocol/legal-and-policies/privacy-policy.md). You acknowledge that information recorded on-chain is **public and permanent** and cannot be deleted, including by us.

## 11. Disclaimers

The Service is provided **"as is" and "as available,"** without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any blockchain network will operate as expected.

**Nothing in or through the Service is financial, investment, tax, or legal advice.**

## 12. Limitation of liability

To the maximum extent permitted by law, we and YuCROWN will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, assets, keys, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of: (i) the total amount you paid to Kong Group LLC for the specific service during the **three (3) months** preceding the claim, or (ii) **USD $100.00**. Some jurisdictions do not allow these limits, so they may not fully apply to you.

## 13. Indemnification

You agree to indemnify and hold harmless us and YuCROWN from any claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms.

## 14. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you breach these Terms or to protect the Service or its users. Termination does not affect your sovereign on-chain assets: your NaviStars and Realm remain yours and on-chain regardless of your access to the Service.

## 15. Restricted jurisdictions and sanctions

You may not use the Service if you are located in, ordinarily resident in, or organized under the laws of any country or region subject to comprehensive sanctions, or if you are listed on any applicable restricted-party or sanctions list. You represent that you are not subject to such restrictions.

## 16. Changes to these Terms

**We may update these Terms. Each version carries a version number and effective date. For material changes (including changes to pricing, dispute resolution, or your rights and obligations), we will provide notice and require your renewed agreement before you continue to use paid or on-chain features; non-material changes take effect on posting, and your continued use constitutes acceptance. Initiating any payment, mint, or Cast constitutes your agreement to the version of these Terms then in effect.**

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms with a new "Last updated" date or notifying you through the Service). Your continued use after the changes take effect means you accept the updated Terms.

## 17. Governing law and disputes

These Terms are governed by the laws of the **State of New Jersey, USA**, without regard to its conflict-of-laws rules.

These Terms and any dispute arising hereunder shall be governed by the laws of the State of New Jersey, without regard to its conflict of laws principles. **ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THE SERVICE, THE PROTOCOL, OR THESE TERMS SHALL BE RESOLVED INDIVIDUALLY THROUGH BINDING INDIVIDUAL ARBITRATION, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR CONSOLIDATED PROCEEDING.** The arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The seat and venue of arbitration shall be Newark, Essex County, New Jersey.
